Wealth Enhancement Mobile App Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Wealth Enhancement Mobile Application (the “App”). 
The App is owned, licensed, and operated by Wealth Enhancement Group, LLC (“WEG,” “we,” “us,” or “our”).

By using the App, you acknowledge the following:

• You have read, understand, and agree to be legally bound by these Terms.
• You agree to the accompanying Privacy Policy, which explains how your data is collected and processed.
• You have the authority to accept these Terms on behalf of yourself or any entity you represent.
• You will comply with all applicable laws, regulations, and regulatory standards related to financial services and mobile applications.

If you do not agree with any part of these Terms, you may not use or access the App.

To ensure clarity, the following defined terms apply throughout:

• “Client” – A Wealth Enhancement Group client granted authorized access to the App.
• “Advisor” – A WEG financial advisor, representative, or supervised person with permissions to access client-related data.
• “User” – Any Client, Advisor, or authorized WEG employee accessing the App.
• “Personal Information” – Information that identifies or relates to a or household
• “Service Provider” – Third-party vendors assisting WEG in operating the App under contractual obligations aligned with applicable privacy laws.
• “Processing” – Any collection, handling, usage, storage, disclosure, transmission, or disposal of Personal Information.

These Terms apply to all user interactions with the App, including content viewing, account authentication, document uploads, messaging features, and data synchronization with Salesforce, AWS, and other integrated systems.

Use of the App is contingent upon:

Eligibility

You are eligible to use the App only if you are:

• An active WEG client,
• A WEG advisor with assigned user permissions, or
• A WEG employee requiring access as part of job duties.

Prohibited Activities

Users may not:

• Attempt to access accounts or data they are not authorized to view.
• Reverse engineer, decompile, modify, or copy any portion of the App.
• Use automated scripts, bots, or unauthorized tools to interact with the App.
• Introduce malware, vulnerabilities, or attempt to bypass security controls.
• Use the App for unlawful purposes, including financial fraud or misrepresentation.
• Upload content prohibited by law, regulatory requirements, or WEG internal policy.

Violation of these rules may result in suspension, termination, or reporting to regulators (e.g., FINRA, SEC) and could lead to legal action.

The App provides data sourced from custodians, Orion, eMoney , Salesforce, internal WEG systems, and held-away account aggregators. 
WEG makes reasonable efforts to ensure accuracy but:

• Data may not always reflect real-time balances.
• Certain feeds may refresh daily, hourly, or near real time depending on system design.
• Historical data may be incomplete or delayed based on custodial processing (e.g., T+1 settlement).
• Aggregated data may depend on third-party services.

Users agree not to rely solely on App data for financial decisions without consulting their Advisor.

WEG complies with:

• Gramm-Leach-Bliley Act (“GLBA”) and Regulation P
• California Privacy Laws (CCPA/CPRA)
•  
• SEC and FINRA recordkeeping requirements
• State data protection and breach notification statutes
• NIST security standards for data protection

Your continued access is conditioned upon using the App in a manner consistent with these regulatory frameworks.

WEG is required to:

• Retain documents and records for at least seven (7) years after a client relationship ends.
• Store uploads using secure, encrypted AWS S3 and archival AWS Glacier storage.
• Maintain audit trails, logs, and system access records as part of regulatory supervision.
• Dispose of data following NIST 800-88 approved destruction methods.

Users may not request deletion of records that WEG is legally required to retain.

All content, design elements, code, trademarks, and data architecture related to the App are the intellectual property of WEG or its licensors. 
You may not reproduce or distribute them without authorization.

WEG uses enterprise-grade security controls. 
Users agree to:

• Protect login credentials and notify WEG if credentials are compromised.
• Only use the App on secure, trusted devices.
• Not jailbreak, root, or modify the device in ways that weaken security.
• Report suspected vulnerabilities immediately.

You agree to defend, indemnify, and hold harmless WEG and its affiliates from claims, damages, or liabilities arising from:

• Unauthorized or improper use of the App
• Violations of these Terms
• Misuse of client or financial information
• Security breaches caused by your device or actions

WEG provides the App “as is” and “as available.” 
WEG does not warrant:

• Uninterrupted access
• Real-time data accuracy
• Error-free performance
• Compatibility with all devices
• That third-party data feeds will always function

To the fullest extent permitted by law:

• WEG is not liable for indirect, incidental, special, or consequential damages.
• Total liability is limited to the amount paid for App usage (typically $0).

All disputes will be resolved by binding arbitration in Hennepin County, Minnesota. 

Minnesota state law governs these Terms.

WEG may update these Terms periodically. 

Continued use constitutes acceptance of updated Terms.
